Kenyan Ambushes Masengeli in Court

Charles Mugane, the lawyer who had filed a petition to remove Deputy Inspector General Gilbert Masengeli from office on Friday pulled the unconventional and served the police boss in court.

The lawyer served Masengeli when the former Acting Inspector General presented himself in court to plead his case on why he should not do time in jail after Justice Lawrence Mugambi convicted him to six months in prison.

The advocate was pictured leaning over to serve Masengeli who was seated next to National Assembly Majority Whip Sylvannus Osoro, other senior police bosses and a battery of lawyers.

“The Rule of Law and Citizen’s power,” the lawyer posted on his official social media handles.

Mugane, an advocate and human rights activist had on Wednesday September 18, filed a petition to have Masengeli removed from office for contempt of court.

In his petition, the lawyer argued that the Deputy IG, during his stint as Acting Inspector General had violated chapter 6 of the constitution and the Leadership and Integrity Act.

Masengeli had ignored court summons seven times. The senior police officer was supposed to explain the whereabouts of activist Bob Njagi and two brothers, Jamil and Aslam Longton who had been kidnapped in Kitengela back in August.

“Anytime served in office by Masengeli after his conviction is nothing but a gross mutilation and dismemberment of the very constitution that we so much pride in and in whose defence he swore to uphold,” the advocate stated.

The three missing persons were however released in the wee hours of Friday September 20 by their captors which coincidentally was the same day Masengeli was supposed to start serving his sentence.

During the court proceedings on Friday, Masengeli apologized to Justice Mugambi and attributed his failure to appear in court to his duties requiring him to attend to critical matters of national security.

Justice Lawrence Mugambi nonetheless announced the suspension of Masengeli’s sentence, which was to commence on Friday, for seven days.

During the court proceedings where the Attorney General is representing the DIG, the ambush was not the most peculiar thing as another clip shows AG Dorcas Oduor clashing with the LSK lawyers before being held back by Sylvanus Osoro.
